Terms and Conditions
Article 1 – Definitions
In these terms and conditions, the following definitions apply:
Cooling-off period: the period within which the consumer may exercise the right of withdrawal;
Consumer: the natural person who is not acting for purposes relating to their trade, business, or profession and enters into a distance contract with the entrepreneur;
Day: calendar day;
Extended transaction: a distance contract relating to a series of products and/or services for which the delivery and/or purchase obligation is spread over time;
Durable medium: any means that enables the consumer or entrepreneur to store information addressed personally to them in a way that allows future consultation and unchanged reproduction of the stored information;
Right of withdrawal: the possibility for the consumer to cancel the distance contract within the cooling-off period;
Entrepreneur: the natural or legal person who offers products and/or services to consumers at a distance;
Distance contract: a contract concluded within the framework of an organized system for distance selling of products and/or services, whereby exclusive use is made of one or more means of distance communication up to and including the conclusion of the contract;
Means of distance communication: any means that can be used to conclude a contract without the consumer and entrepreneur being simultaneously present in the same place;
Terms and Conditions: the present Terms and Conditions of the entrepreneur.
Article 2 – Applicability
These Terms and Conditions apply to every offer made by the entrepreneur and to every distance contract and order concluded between the entrepreneur and the consumer.
Before the distance contract is concluded, the text of these Terms and Conditions will be made available to the consumer. If this is not reasonably possible, it will be indicated where the Terms and Conditions can be inspected and that they will be sent free of charge upon request.
If the contract is concluded electronically, the Terms and Conditions may be provided electronically in such a way that the consumer can store them on a durable medium.
If specific product or service conditions apply in addition to these Terms and Conditions, the consumer may always rely on the provision most favorable to them in the event of conflicting terms.
If any provision of these Terms and Conditions is wholly or partially void, the remainder remains in force and the provision will be replaced by one that closely reflects the original intention.
Situations not covered shall be assessed in the spirit of these Terms and Conditions.
Article 3 – The Offer
If an offer has a limited validity or is subject to conditions, this will be explicitly stated.
The offer is non-binding. The entrepreneur may modify or adjust it.
The offer includes a complete and accurate description of the products and/or services. Images are a truthful representation. Obvious errors do not bind the entrepreneur.
Images and specifications are indicative and cannot give rise to compensation. Colors shown may differ from actual colors.
Each offer clearly states the rights and obligations attached to acceptance, including:

the price (excluding customs clearance costs and import VAT)

shipping costs

how the contract is concluded
-
whether the right of withdrawal applies
-
payment, delivery and execution methods
-
acceptance period
-
communication costs
-
whether the contract is archived
-
how data can be corrected
-
available languages
-
applicable codes of conduct

minimum duration for extended transactions

Article 4 – The Contract
The contract is concluded when the consumer accepts the offer and complies with the conditions.
Electronic acceptance is confirmed electronically. Until confirmation, the consumer may dissolve the contract.
The entrepreneur ensures secure data transmission and a safe web environment.
The entrepreneur may investigate the consumer’s ability to meet payment obligations and may refuse or impose conditions if justified.
The consumer will receive, in writing or durable form:

warranty information
-
contract details
-
termination requirements
All contracts are subject to product availability.
Article 5 – Right of Withdrawal
The consumer may cancel the contract within 30 days without giving reasons. The period starts the day after receipt.
During this period, the consumer must handle the product carefully and return it in original condition and packaging.
The consumer must notify the entrepreneur within 30 days and return the product within 30 days thereafter, providing proof of shipment.
If not done within this period, the purchase becomes final.
Article 6 – Costs in Case of Withdrawal
Return costs are borne by the consumer.
Refunds will be made within 30 days after withdrawal, provided the product has been received or proof of return has been supplied.
Article 7 – Exclusion of Right of Withdrawal
Withdrawal may be excluded for:

custom-made products
-
personal products
-
perishable goods
-
products tied to market fluctuations
-
newspapers/magazines
-
unsealed audio/video/software
-
unsealed hygienic products
And for services such as accommodation, transport, catering, leisure activities on specific dates, or gambling/lotteries.
Article 8 – The Price
Prices will not increase during the validity period except for VAT changes.
Variable pricing may apply to products tied to market fluctuations.
No VAT will be charged if delivery occurs outside the EU; import VAT may be charged by the carrier.
Printing errors are reserved.

Article 10 – Conformity and Warranty
Products comply with the agreement and legal standards.
Warranty does not affect statutory rights.
Defects must be reported within 30 days. Returns must be in original packaging.
Warranty does not apply in case of misuse, unauthorized repairs, or abnormal handling.
Article 11 – Delivery and Execution
Orders will be handled with care.
Delivery takes place at the address provided.
Orders are fulfilled within 30 days unless agreed otherwise.
If delivery is delayed or impossible, the consumer may cancel free of charge.
Risk transfers upon delivery to the consumer.
Article 12 – Extended Transactions
Consumers may terminate indefinite contracts with one month’s notice.
Fixed-term contracts may be terminated at the end of the term with one month’s notice.
Automatic renewals are restricted unless cancellation remains possible.
Article 13 – Payment
Payments must be made within 7 working days unless agreed otherwise.
Incorrect payment details must be reported immediately.
In case of default, reasonable costs may be charged.
Article 14 – Complaints Procedure
Complaints must be submitted within 7 days after discovery.
Complaints will be answered within 30 days.
If unresolved, disputes may follow the dispute procedure.
Valid complaints will lead to repair or replacement.
Article 15 – Disputes
Dutch law exclusively applies to all agreements.
Article 16 – CESOP
Due to measures introduced from 2024 related to the implementation of the Central Electronic System of Payment Information (CESOP), payment service providers may register transaction data in the European CESOP system.
